Welcome to Photo Canvas Pro. These Terms of Service ("Terms") govern your use of the Photo Canvas Pro Chrome extension and website (collectively, the "Service") operated by Photo Canvas Pro ("we", "us", or "our").

4. Intellectual Property

The Service and all Content, features, and functionality, including but not limited to all designs, text, graphics, logos, icons, images, software, and code, are the exclusive property of Photo Canvas Pro or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes. This license does not include the right to:

5. Premium Services

5.1 Subscription Terms

The Premium Version of Photo Canvas Pro requires payment of subscription fees as outlined on our website. By subscribing to the Premium Version, you agree to pay all fees in accordance with the pricing and payment terms in effect at the time of your subscription or renewal.

5.2 Payment and Billing

We may use third-party payment processors to bill you for the Premium Version. By subscribing, you agree to provide accurate and complete billing information and authorize us to charge your payment method for all fees incurred.

5.3 Refunds

All purchases are final and non-refundable, except in cases where refunds are required by law. If you believe you are entitled to a refund, please contact our support team.

5.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to the Premium Version until the end of your current billing period, after which your access will revert to the Free Version.

6. User Content

6.1 Image Processing

Our Service processes images that you select. All image processing occurs locally on your device. We do not store, transmit, or access the content of your images unless explicitly required for features you have actively enabled (such as Google Photos integration in the Premium Version).

6.2 Content Ownership

You retain all ownership rights to your images and other content processed through our Service. By using our Service, you grant us a limited license to process your images solely for the purpose of providing the Service functionality you have requested.

7. Prohibited Activities

When using our Service, you agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Use the Service to process or distribute illegal, harmful, offensive, or inappropriate content
• Attempt to interfere with, disrupt, or disable any features of the Service

WE DO NOT WARRANT THAT:

• THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS
• THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE
• THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS
• ANY ERRORS IN THE SERVICE WILL BE CORRECTED

9. Limitation of Liability

IN NO EVENT SHALL PHOTO CANVAS PRO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
• ANY CONTENT OBTAINED FROM THE SERVICE
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN ANY CASE, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

10. Indemnification

You agree to defend, indemnify, and hold harmless Photo Canvas Pro, its directors, employees, partners, agents, suppliers, and affiliates, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

11. Term and Termination

These Terms will remain in full force and effect while you use the Service. We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

13. Governing Law
